Reg. 82333, Dec. 18, 2020)<\/strong>, the DEA pledged<\/a> that marijuana manufacturing licenses would be tied to FDA science and genuine medical research. The agency declared:<\/p>\n “DEA will evaluate each application\u2026 to determine whether the applicant’s proposed activities\u2026 will promote medical research.”<\/strong><\/p>\n<\/li>\n “DEA will require applicants to demonstrate bona fide supply agreements with researchers authorized by the FDA to conduct clinical research.”<\/strong><\/p>\n<\/li>\n “DEA’s goal is to ensure that the United States has a sufficient supply of marihuana to meet the legitimate medical, scientific, and research needs of the United States.”<\/strong><\/p>\n<\/li>\n<\/ul>\n These were the promises.<\/strong><\/p>\n The Harsh Reality<\/strong><\/p>\n But DEA’s actions told a different story:<\/p>\n Licenses granted to companies with no FDA INDs<\/strong>, no clinical trial protocols, and no scientific foundation.<\/p>\n<\/li>\n No bona fide supply agreements<\/strong> with FDA-authorized researchers – a direct violation of DEA’s own Final Rule.<\/p>\n<\/li>\n Four years later, there is still no adequate, federally compliant supply of cannabis for clinical trials<\/strong>, leaving patients with Huntington’s Disease, Multiple Sclerosis, and other conditions waiting.<\/p>\n<\/li>\n<\/ul>\n The only company that meets DEA’s own published criteria<\/strong> – MMJ BioPharma, with two FDA-filed INDs and an Orphan Drug Designation – has been stalled while non-scientific registrants received licenses.<\/p>\n Promises Made, Promises Not Kept<\/strong><\/p>\n DEA’s marijuana program has been a case study in mismanagement:<\/p>\n Rules written, then ignored.<\/strong><\/p>\n<\/li>\n Patients promised access, then denied it.<\/strong><\/p>\n<\/li>\n Science promised priority, then sidelined.<\/strong><\/p>\n<\/li>\n<\/ul>\n President Trump’s possible rescheduling decision shines a spotlight on this failure.
