CDC plans for updates to [the CDC guideline on isolation precautions] to be accomplished in stages over a period of several years. The first step is to complete a framework document that will be part one of the updated <em>Guideline to Prevent Transmission of Pathogens in Healthcare Settings<\/em> (\u201cGuidance\u201d). The framework provides the scientific foundations that will be used when prevention recommendations are developed for specific pathogens and clinical situations that will be subsequently developed through HICPAC as part two of the guideline.<\/p>\n<\/blockquote>\n<p>To set the scene for the bureaucratic knifework to come: The draft \u201cGuidance\u201d of the last HICPAC meeting, which proposed to weaken patient protections from Covid, raised such a furor (\u201c<a href=\"https:\/\/www.nakedcapitalism.com\/2023\/11\/cdcs-hicpac-passes-draft-gutting-patient-protections-against-airborne-respiratory-viruses-faces-challenge-at-hhs-office-of-the-inspector-general-and-you-can-help.html\">murderous abomination<\/a>\u201c) that it was returned by HICPAC to its masters at CDC. Jernigan and Howard then attempted to get HICPAC back on track, in January, by writing a letter to them that posed four questions for HICPAC to answer as it redrafted the Guidance. The deliverables presented, in November, at the meeting I am about to describe, enabled HICPAC to answer CDC\u2019s four questions.<\/p>\n<p>In this post, as a preliminary, I will first review HICPAC\u2019s compliance at this meeting with issues raised by the World Health Network (WHN) with the Inspector General of Health and Human Services, the parent agency of CDC. I will then present CDC\u2019s four questions, followed by HICPAC\u2019s definition of masks. Next, I will look at two deliverables, <a href=\"https:\/\/www.cdc.gov\/hicpac\/media\/pdfs\/HCP-WG-HICPAC-Nov-2024-508.pdf\" target=\"_blank\" rel=\"nofollow noopener\">Infection Control in Healthcare Personnel Workgroup<\/a> (\u201cInfection Control\u201d) and <a href=\"https:\/\/www.nakedcapitalism.com\/2024\/11\/Isolation%20Precautions%20Guideline%20Workgroup\" target=\"_blank\" rel=\"nofollow noopener\">Isolation Precautions Guideline Workgroup<\/a> (\u201cIsolation Precautions\u201d), that HICPAC used to answer CDC\u2019s four questions. After looking at HICPAC\u2019s answers to those questions, I will conclude. (The meeting ran over two days, and unfortunately I did not have time to listen to the video recordings for <a href=\"https:\/\/www.youtube.com\/live\/36sqBndluEw\" target=\"_blank\" rel=\"nofollow noopener\">November 14<\/a> and <a href=\"https:\/\/www.youtube.com\/live\/rnf2gWXMtNI\" target=\"_blank\" rel=\"nofollow noopener\">15<\/a>, 9 hours 44 minutes and 4 hours 31 minutes respectively. Public comments were held November 15, at the end of the meeting.) Here are two articles (<a href=\"https:\/\/www.forbes.com\/sites\/judystone\/2024\/11\/21\/cdc-weighs-lowering-infection-protections-even-more\/\" target=\"_blank\" rel=\"nofollow noopener\">Judy Stone in Forbes<\/a>; <a href=\"https:\/\/www.infectioncontroltoday.com\/view\/cdc-hicpac-considers-new-airborne-pathogen-guidelines-amid-growing-concerns\" target=\"_blank\" rel=\"nofollow noopener\">Infection Control Today<\/a>) that handle this HICPAC meeting at a higher level.<\/p>\n<p><strong>Compliance Issues at HICPAC<\/strong><\/p>\n<p>For a detailed discussion of World Health Network\u2019s Complaint, <a href=\"https:\/\/www.nakedcapitalism.com\/2024\/11\/CDC%E2%80%99s%20HICPAC:%20Conflicts%20of%20Interest%20and%20Process%20Violations%20Alleged%20in%20World%20Health%20Network%20Supplemental%20Complaint%20to%20Inspector%20General\" target=\"_blank\" rel=\"nofollow noopener\">see NC here<\/a>. <\/p>\n<p><strong><em>(1) Quorum<\/em><\/strong>. Here HICPAC improved; past meetings were held without a quorum. This one was held with one.<\/p>\n<p><strong><em>(2) Secrecy<\/em><\/strong>. Yaneer Bar-Yam of World Health Network <a href=\"https:\/\/bsky.app\/profile\/yaneerbaryam.bsky.social\/post\/3layftvx3ts2v\" target=\"_blank\" rel=\"nofollow noopener\">posted<\/a>:<\/p>\n<p><img fetchpriority=\"high\" fetchpriority=\"high\" decoding=\"async\" src=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/secrecy.png\" alt=\"\" width=\"500\" height=\"160\" class=\"aligncenter size-full wp-image-282839\" srcset=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/secrecy.png 500w, https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/secrecy-300x96.png 300w\" sizes=\"(max-width: 500px) 100vw, 500px\"\/><\/p>\n<p>HICPAC\u2019s workgroups produced Infection Control and Isolation Precautions for the full committee to vote on, so this is a big deal.<\/p>\n<p><strong><em>(3) Committee Composition<\/em><\/strong>. Yaneer Bar-Yam of World Health Network <a href=\"https:\/\/bsky.app\/profile\/yaneerbaryam.bsky.social\/post\/3layftvx3ts2v\" target=\"_blank\" rel=\"nofollow noopener\">once more<\/a>:<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/expertise.png\" alt=\"\" width=\"500\" height=\"307\" class=\"aligncenter size-full wp-image-282840\" srcset=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/expertise.png 500w, https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/expertise-300x184.png 300w\" sizes=\"(max-width: 500px) 100vw, 500px\"\/><\/p>\n<p>On committee composition, <a href=\"https:\/\/blogs.cdc.gov\/safehealthcare\/draft-2024-guideline-to-prevent-transmission-of-pathogens-in-healthcare-settings\/\" target=\"_blank\" rel=\"nofollow noopener\">Jernigan and Howard wrote<\/a>:<\/p>\n<blockquote>\n<p>CDC is working to expand the scope of technical backgrounds of participants on the HICPAC Isolation Guideline Workgroup and eventually among the committee members through established processes in accordance with the Federal Advisory Committee Act (FACA) regulations and guidance. The expanded workgroup and the HICPAC with the newly appointed members will review and discuss these additional considerations and guideline at the next HICPAC meeting, which is open to the public.<\/p>\n<\/blockquote>\n<p>HICPAC has in fact expanded workgroups to include specialists in airborne transmission. But these specialists are not full members of the committee, and therefore have no voting rights. So are we <em>really<\/em> going to complete the Guidance without giving scientists or engineers a vote? <\/p>\n<p><strong><em>(4) Conflict of Interest<\/em><\/strong>. <a href=\"https:\/\/www.nakedcapitalism.com\/2024\/10\/cdcs_hicpac_conflicts_interest_process_violations_alleged_world_health_network_supplemental_complaint_inspector_general.html\">Summarizing WHN\u2019s complaint<\/a>, I wrote (and forgive the length and breadth of the elephant in the room):<\/p>\n<blockquote>\n<p>WHN has now gone for what is <em>really<\/em> the jugular: Following the money.<\/p>\n<p><em>A. Financial Relationships<\/em>. WHN writes:<\/p>\n<blockquote>\n<p>An important principle of FACA is that employees of the agency that is being advised (in this case, the CDC) are not allowed to be members of the committee due to the inherent nature of financial relationships that may preclude independence. While funding is not strictly forbidden, it is apparent that conflict of interest should be avoided.<\/p>\n<p>A financial relationship between the institution and individual members such as that which currently exists between CDC and virtually all of the members of the HICPAC committee seriously risks comprising the independence of their judgment. This is the case not merely because funding links may influence particular decisions, but also because .<\/p>\n<\/blockquote>\n<p>To put it crudely, if CDC\u2019s handwashing desk writes your HICPAC check, you will be unlikely to give airborne transmission the attention it deserves.<\/p>\n<p><em>B. Competition for Funding with Rival Siloes<\/em>. WHN writes:<\/p>\n<blockquote>\n<p>Furthermore, members of HICPAC, recognized for their expertise in areas such as bloodstream infections, sepsis, sharps injuries, hand hygiene, fomite transmission, sterilization and disinfection, antimicrobial resistance, and Ebola, are . This creates a potential conflict of interest which may interfere with a decision to shift the focus of infection prevention to airborne diseases, which is required to deal effectively with the hospital-based transmission of COVID-19.  [IPC], and that of their colleagues. This inherent tension is compounded by similar conflicts of interests among CDC officials responsible for nominating HICPAC members and setting the committee\u2019s agenda, including the current and former HICPAC Federal Officers and the director of NCEZID.<\/p>\n<\/blockquote>\n<p>I don\u2019t know anybody who has an issue with threatening IPC. Do you? (And if these two sections make HICPAC and CDC seem like a snakepit of self-dealing, well, it looks like that\u2019s what it is. It would also be interesting to know if the CDC Foundation is hooked into this \u201cinherent tension\u201d at all.)<\/p>\n<p><em>C. Perverse Incentives in Fee-for-Service Systems from Hospital-Acquired Infections<\/em>. WHN writes:<\/p>\n<blockquote>\n<p>HICPAC\u2019s Charter mandates providing guidance on \u201cprevention, and control of healthcare-associated infections\u201d Therefore, committee members that are compensated for encouraging spread of infection (or compensated for being knowingly or willfully ignorant of the science of infection control in a healthcare setting), are in conflict of interest with HICPAC\u2019s objective.<\/p>\n<p>More specifically, it is well established that direct payment systems can lead to perverse incentives against the prevention of hospital-acquired infections (HAIs). In fee-for-service payment models, hospitals are reimbursed for services provided, including the treatment of HAIs. In such a system, hospitals can generate more revenue by providing additional care to treat these infections, rather than by preventing them in the first place. <\/p>\n<\/blockquote>\n<\/blockquote>\n<p>At the start of the meeting, the roll is called as the quorum is taken. The Committee members answer with their names and Conflicts of Interest. It\u2019s amusing to hear so many of them say \u201cno conflict.\u201d Same as it ever was. Nothing has changed.<\/p>\n<p><strong>CDC\u2019s Four Questions<\/strong><\/p>\n<p>From <a href=\"https:\/\/blogs.cdc.gov\/safehealthcare\/draft-2024-guideline-to-prevent-transmission-of-pathogens-in-healthcare-settings\/\" target=\"_blank\" rel=\"nofollow noopener\">Jernigan and Howard\u2019s letter<\/a>, here they are:<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/cdc_questions.png\" alt=\"\" width=\"600\" height=\"402\" class=\"aligncenter size-full wp-image-282836\" srcset=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/cdc_questions.png 600w, https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/cdc_questions-300x201.png 300w\" sizes=\"(max-width: 600px) 100vw, 600px\"\/><\/p>\n<p>In what follows, I\u2019m going to focus only on masks (and respirators), because universal use of respirators in hospital settings is my <del>hobbyhorse<\/del> policy goal. <\/p>\n<p class=\"p12\"><strong>Infection Control in Healthcare Personnel Workgroup<\/strong><\/p>\n<p>For <a href=\"https:\/\/www.cdc.gov\/hicpac\/media\/pdfs\/HCP-WG-HICPAC-Nov-2024-508.pdf\" target=\"_blank\" rel=\"nofollow noopener\">Infection Control<\/a>, I\u2019m going to look at just one footnote: footnote 17 on page 19:<\/p>\n<p><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/hcp_workgroup_19_footnote-17.png\" alt=\"\" width=\"600\" height=\"334\" class=\"aligncenter size-full wp-image-282821\" srcset=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/hcp_workgroup_19_footnote-17.png 600w, https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/hcp_workgroup_19_footnote-17-300x167.png 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"\/><\/p>\n<p>Here is the note itself, on page 59:<\/p>\n<p><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/hcp_workgroup_59_footnote_17_text-e1732562505293.png\" alt=\"\" width=\"600\" height=\"41\" class=\"aligncenter size-full wp-image-282822\" srcset=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/hcp_workgroup_59_footnote_17_text-e1732562505293.png 600w, https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/hcp_workgroup_59_footnote_17_text-e1732562505293-300x21.png 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"\/><\/p>\n<p>From page 19, helpfully highlighted at the bottom:<\/p>\n<blockquote>\n<p>Authors [sic] conclusion: wearing a surgical mask for source control is highly protective against transmission<\/p>\n<\/blockquote>\n<p>From the actual article, \u201c<a href=\"https:\/\/pmc.ncbi.nlm.nih.gov\/articles\/PMC8390095\/\" target=\"_blank\" rel=\"nofollow noopener\">Risk of SARS-CoV-2 transmission from universally masked healthcare workers to patients or residents: A prospective cohort study<\/a>,\u201d in the conclusion:<\/p>\n<blockquote>\n<p>Our study provides evidence that universal masking, , is associated with low risk of transmission of SARS-CoV-2 from healthcare workers to patients and residents.<\/p>\n<\/blockquote>\n<p class=\"p13\">In other words, in their version of the authors\u2019 conclusion, the authors of Infection Control, workgroup chair Connie Steed and David Kuhar left out all the confounders (helpfully underlined). <\/p>\n<p><strong>Isolation Precautions Guideline Workgroup<\/strong><\/p>\n<p>This is the knifework part. Evidently \u2014 although since the Workgrup deliberations are secret, violating FACA, as WHN points out above, we can\u2019t be sure \u2014 this workgroup was organized along Team A\/Team B lines, where Team A is hospital infection control administrators, and Team B is scientists and engineers familiar with aerosol tranmission. For the Guidance, each team produced \u201cnarratives.\u201d From Isolation Precautions, page 69:<\/p>\n<p><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/narratives_69.png\" alt=\"\" width=\"600\" height=\"312\" class=\"aligncenter size-full wp-image-282829\" srcset=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/narratives_69.png 600w, https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/narratives_69-300x156.png 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"\/><\/p>\n<p>And the narratives of each team were supported by different classes of evidence: \u201cclinical\u201d (no doubt hospital administrators) and \u201claboratory\u201d (no doubt scientists and engineers, though heaven knows there are fine studies done on aerosol tranmission, too). From Isolation Precautions, page 70:<\/p>\n<p class=\"p13\"><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/narratives_70.png\" alt=\"\" width=\"600\" height=\"231\" class=\"aligncenter size-full wp-image-282830\" srcset=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/narratives_70.png 600w, https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/narratives_70-300x116.png 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"\/><\/p>\n<p> I\u2019ll just leave this here, for now, but we\u2019ll get back to the knifework in the Conclusion:<\/p>\n<p><strong>HICPAC Answers CDC\u2019s Four Questions<\/strong><\/p>\n<p>Here now are HICPAC\u2019s answers. As you can see, the results are a rout for Narrative B (respirators). Baggy Blues \u00fcber alles! Let\u2019s take the questions one by one\u201d<\/p>\n<p><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/vote_1.png\" alt=\"\" width=\"600\" height=\"270\" class=\"aligncenter size-full wp-image-282823\" srcset=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/vote_1.png 600w, https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/vote_1-300x135.png 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"\/><\/p>\n<p>On the bright side, <em>finally<\/em> HICPAC admits airborne transmission. Sadly, \u201cN95 respirators should not be recommended for all pathogens that spread by air.\u201d (And think about that for a moment. What happens if there are multiple airborne pathogens in a given hospital simultaneously? Should the most protective (respirator) or least (mask) be used? Will hospital administrators be issuing memos on mask v. respirator use on a daily for weekly basis? (Keeps \u2019em busy, I supppse.) Why not go for the simplest solution that\u2019s effective in all cases?<\/p>\n<p><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/vote_2.png\" alt=\"\" width=\"600\" height=\"294\" class=\"aligncenter size-full wp-image-282824\" srcset=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/vote_2.png 600w, https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/vote_2-300x147.png 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"\/><\/p>\n<p>\u201cEfficiency of spread over long distances, such as through ventilation systems\u201d? I can\u2019t believe Team B allowed that. The Japanese 3C\u2019s concept applies to a hospital room or war just as much as a restaurant: closed spaces, crowded places, and close-contact. Further, aersols move like smoke and gradually fill rooms. In neither case is \u201clong distance\u201d an appropriate model.<\/p>\n<p><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/vote_3.png\" alt=\"\" width=\"600\" height=\"302\" class=\"aligncenter size-full wp-image-282825\" srcset=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/vote_3.png 600w, https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/vote_3-300x151.png 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"\/><\/p>\n<p>The least HICPAC could do is ask for the regulation to be changed.<\/p>\n<p><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/vote_4.png\" alt=\"\" width=\"600\" height=\"270\" class=\"aligncenter size-full wp-image-282826\" srcset=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/vote_4.png 600w, https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/11\/vote_4-300x135.png 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"\/><\/p>\n<p>\u201cDetermined by local risk of pathogen transmission and epidemiology, rather than at all times\u201d has some problems. First, to assess the risk, you need to test, and for all airborne pathogens, but HICPAC isn\u2019t recommending that. Second, assume that HICPAC recommends periodic testing for some pathogens. N95s with proper headstraps are less gappy by construction; and with fit-testing, not gappy at all. Further, N95s are made from non-woven fabric with a static electrical charge; air gets in and out, but the charge traps particles like Covid viruses. Baggy Blues are better than cloth masks, but they don\u2019t have the static charge, so again, N95s are better by construction. Baggy blues are simply not as good as N95s, let alone respirators, meaning that fewer people will get sick and die with N95s than with Baggy Blues, which you\u2019d think would matter to hospitals, but I guess not. But HICPAC vociferously maintains that they <em>are<\/em> as good.<\/p>\n<p>How then is it possible for smart people to be so stupid? Leaving aside <del>corruption<\/del> conflict of interest, the very simplest explanation is to look at the bureaucratic knifework (I told you I\u2019d come around to it again). You will recall that Isolation Precautions said there were two kinds of evidence: Clinical (Team A, masks) and Laboratory (Team B, respirators). So where are all the people favoring Laboratory Evidence? That\u2019s right. In the Workgroups, <em>with no vote<\/em>. And who are the people favoring Clinical Evidence? Yes, clinicians. On the Committee, <em>with a vote<\/em>.
