Andy Ogles (R-Tenn.) filed articles of impeachment against Vice President Harris on Tuesday, as Republicans ramp up attacks while she launches a presidential campaign\u2026. The filing expands on previously introduced articles that target Harris\u2019s record on immigration\u2026 He added a second article in the new filing, which claims Harris covered up President Biden\u2019s mental well-being, constituting a \u2018breach of public trust.&#8217;\u201d \u2022 I don\u2019t the immigration stuff is impeachable, so I\u2019ll skip that part. But here are Ogle\u2019 articles of impeachment, and here is the Twenty-Fifth Amendment section, which I have helpfully annotated:<\/p>\n<p><img fetchpriority=\"high\" fetchpriority=\"high\" decoding=\"async\" src=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/07\/harris_impeachment_article_2.png\" alt=\"\" width=\"500\" height=\"838\" class=\"aligncenter size-full wp-image-275589\" srcset=\"https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/07\/harris_impeachment_article_2.png 500w, https:\/\/www.nakedcapitalism.com\/wp-content\/uploads\/2024\/07\/harris_impeachment_article_2-179x300.png 179w\" sizes=\"(max-width: 500px) 100vw, 500px\"\/><\/p>\n<p>[1] I don\u2019t think failing to act upon a putative \u201cmoral obligation\u201d is an impeachable offense \u201cTreason, Bribery, or other high Crimes and Misdemeanors\u201d).Here once again is the relevant part of the Twenty Fifth Amendment:<\/p>\n<blockquote>\n<p>Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.<\/p>\n<\/blockquote>\n<p>The Twenty Fifth Amendment gives the Vice President (Kamala) the <em>power<\/em> to \u201cdeclare\u201d \u201cthat the President is unable to discharge the powers and duties of his office,\u201d but it imposes no duty to do so. \u201cMoral obligation\u201d or no, there\u2019s no <em>Constitutional<\/em> obligation.<\/p>\n<p>[2] So what?<\/p>\n<p>[3] \u201cBreaches of public trust\u201d, \u201cfailing basic expectations,\u201d and \u201clack of integrity\u201d are not high crimes and misdeameanors either. Yikes! <\/p>\n<p><center>* * *<\/center><\/p>\n<p><a name=\"defenestration\"\/>Biden Defenestration:<\/p>\n<p>\u201cBiden was deathly pale\u2026 Air Force One was flying so fast I felt sick: Daily Mail\u2019s reporter on board reveals the incredible inside story of the mad rush to get Joe to Covid isolation \u2013 and why she feared for him\u201d [<a href=\"https:\/\/www.dailymail.co.uk\/news\/article-13664787\/Biden-deathly-Air-Force-One-covid-isolation-secret-rush.html\" target=\"_blank\" rel=\"nofollow noopener\">Daily Mail<\/a>]. \u201cWhen [Biden] finally stepped through the door, his appearance was shocking. He looked pale, weak, exhausted and shuffled slowly across the room. \u2018He looks bad,\u2019 one reporter muttered. We all agreed. [Unmasked,] Biden greeted [and potentially infected] the patrons, shaking hands with families at three different tables and posing for selfies. Finally, a colleague got wind of a tip. The president\u2019s next scheduled event at UnidosUS had been canceled. \u2018Biden has COVID,\u2019 my colleague shouted. Moments later, we could see Karine Jean-Pierre and other senior Biden staff piling into their vans. Once he was on board, we reporters rushed to find our seats in the back of the plane. And nearly from the moment we lifted off the runway, the fuselage began to shake. It\u2019s not entirely uncommon for Air Force One pilots to drop the hammer. President Trump routinely asked his crew to cut down flight times by going faster. But this break-neck speed was unusual for President Biden\u2026. The normal flight time from Vegas to Delaware is around four and a half hours. We made the trip in three hours and 48 minutes.\u201d \u2022 Hmm. Makes you wonder if there were any sequelae from his previous two infections (that we know of).<\/p>\n<p>\u201cJoe Biden\u2019s COVID Hubris is the Nail in His Re-Elect Coffin\u201d [Julia Doubleday, <a href=\"https:\/\/www.thegauntlet.news\/p\/joe-bidens-covid-hubris-is-the-nail\" target=\"_blank\" rel=\"nofollow noopener\">The Gauntlet<\/a> (PI)]. \u201cThe truth is that to the DC machine, Joe was, just like the rest of us, ultimately disposable. He served his purpose by serving capital; his maskless face as an elderly man in public was the ultimate propaganda for the disappearance of the virus that ended his career as surely as he claimed to have ended it. He gave his career, his body and his mind to advance the interests of the ruling class, to the detriment of us all. They say life\u2019s a beach, Joe. I guess it is for you, now.\u201d \u2022 He claimed to have ended Covid. Then Covid ended him.<\/p>\n<p><a name=\"trail\"\/><em><strong>The Campaign Trail<\/strong><\/em>:<\/p>\n<p><a name=\"harris\"\/>Trump (R): \u201cBiden dropped his reelection plans. What happens to his campaign war chest?\u201d (interview) [Sean Cooksey, <a href=\"https:\/\/www.npr.org\/2024\/07\/22\/nx-s1-5048037\/biden-dropped-his-reelection-plans-what-happens-to-his-campaign-war-chest\" target=\"_blank\" rel=\"nofollow noopener\">NPR<\/a>]. Cooksey is the Republican Chair of the Federal Election Commission (FEC). \u201cWell, I think it\u2019s really complicated, is the short answer. I mean, we take a step back to consider the situation \u2013 this is really unprecedented in terms of modern political history, and certainly in terms of campaign finance law. We have a presidential nominee or a presumptive nominee dropping out just weeks before his party convention. And he\u2019s \u2013 what he\u2019s attempting to do is to give his entire committee, the cash and all the assets\u2026. [o]ver to another person.\u201d <strong>Q: We get that. So can she use that money?<\/strong> Well, again, I think it\u2019s going to have to go through a process through the FEC. I think I expect there\u2019s going to be probably challenges to that at the agency and probably in the courts, as well\u2026 Yeah. I think there\u2019s a number of different avenues that I could expect different parties to challenge this attempted transfer, this attempted change to the presidential committees. There\u2019s a process in which private parties can file complaints with the Federal Election Commission. There\u2019s also a process in which they prospectively ask for advisory opinions. One of the problems with those processes is they can take a lot of time, and we don\u2019t have a lot of time until the election, I think we\u2019re at 106 days out. And so I think there\u2019s going to be a lot of challenges in the courts as well.\u201d \u2022 Whether or not there are grounds for injunction, I don\u2019t know. (Though now I wonder if <a href=\"https:\/\/www.nakedcapitalism.com\/2024\/07\/200pm-water-cooler-7-23-2024.html#rollout\">redirecting Biden\u2019s site to ActBlue immediately upon his defenestration<\/a> is one of the moving parts here.) Cooksey tweeted the relevant campaign finance law:<\/p>\n<p><center><\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">11 C.F.R. \u00a7 110.1(b)(3):<\/p>\n<p>&#8220;If the candidate is not a candidate in the general election, all contributions made for the general election shall be either returned or refunded to the contributors or redesignated \u2026, or reattributed \u2026, as appropriate.&#8221;<\/p>\n<p>\u2014 Sean Cooksey (@SeanJCooksey) <a href=\"https:\/\/twitter.com\/SeanJCooksey\/status\/1815089842365321563\" target=\"_blank\" rel=\"nofollow noopener\">July 21, 2024<\/a><\/p>\n<\/blockquote>\n<p><\/center><\/p>\n<p>And got a nastygram in return:<\/p>\n<p><center><\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">House Democrats are now trying to silence me as <a href=\"https:\/\/twitter.com\/FEC\" target=\"_blank\" rel=\"nofollow noopener\">@FEC<\/a> Chairman for raising questions about President Biden giving VP Harris all of his campaign cash. All I did was quote federal regulations.<\/p>\n<p>Why are Democrats afraid of the law? <a href=\"https:\/\/t.co\/pYPJOSkPbh\" target=\"_blank\" rel=\"nofollow noopener\">pic.twitter.com\/pYPJOSkPbh<\/a><\/p>\n<p>\u2014 Sean Cooksey (@SeanJCooksey) <a href=\"https:\/\/twitter.com\/SeanJCooksey\/status\/1815819368896307638\" target=\"_blank\" rel=\"nofollow noopener\">July 23, 2024<\/a><\/p>\n<\/blockquote>\n<p><\/center><\/p>\n<p>We don\u2019t actually have even the sketchiest sort of evidence of Biden \u201cgiving\u201d Harris \u201call his campaign cash.\u201d Would a digitally signed Tweet be sufficient? Surely not. It seems that Harris just took it; <a href=\"https:\/\/www.nakedcapitalism.com\/2024\/07\/200pm-water-cooler-7-23-2024.html#rollout\">the process <em>did<\/em> seem a bit brusque<\/a>. I think the matter turns on the two words \u201credesignated\u201d or \u201creattributed\u201d in 11 C.F.R. \u00a7 110.1. I am not a campaign finance law maven, but if either implies a <em>process<\/em> at the FEC, potential litigants might have a point (<a href=\"https:\/\/x.com\/brendan_fischer\/status\/1815770157895053439\" target=\"_blank\" rel=\"nofollow noopener\">based on strict textual reading<\/a>):<\/p>\n<p><center><\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">The Biden-Harris campaigns could have asked for an expedited legal advisory opinion from the FEC before acting. Given the unprecedented nature of the situation, that would have been the ethical thing to do. Instead, they took advantage of the slow timeline to resolve complaints\u2026<\/p>\n<p>\u2014 Laura Powell (@LauraPowellEsq) <a href=\"https:\/\/twitter.com\/LauraPowellEsq\/status\/1815916058748068213\" target=\"_blank\" rel=\"nofollow noopener\">July 24, 2024<\/a><\/p>\n<\/blockquote>\n<p><\/center><\/p>\n<p>And now\u2013<\/p>\n<p>Trump (R): \u201cTrump campaign files complaint with FEC seeking to keep Biden from transferring campaign funds to Harris\u201d [<a href=\"https:\/\/www.cbsnews.com\/news\/trump-campaign-complaint-fec-prevent-biden-funds-transfer-harris\/?ftag=CNM-00-10aab7e&amp;linkId=519641524\" target=\"_blank\" rel=\"nofollow noopener\">CBS<\/a>]. \u201cThe Trump campaign\u2019s general counsel, David Warrington, accuses them of \u201cfiling fraudulent forms with the Commission purporting to repurpose one candidate\u2019s principal campaign committee for the use of another candidate,\u201d claiming that Harris simply replaced Biden\u2019s name with her own rather than filing her own Statement of Candidacy. \u2018There is no provision in federal campaign finance law for Kamala Harris to take over Joe Biden\u2019s candidacy now by quite literally attempting to become him via an amendment of his Form 2, assuming control of his campaign by amending Form 1, and making off with all of his cash,\u2019 wrote Warrington.\u201d Scratch out \u201ccat\u201d and write in \u201cdog.\u201d More: \u201cHans von Spakovsky, a former member of the Federal Election Commission, said in a Fox News op-ed published Sunday that if Harris becomes the presidential nominee, she would get access to the campaign cash. \u2018When the Biden for President Committee filed its registration statement with the FEC, it registered itself as the \u2018principal campaign committee\u2019 for both Joe Biden and Kamala Harris,\u2019 he wrote.\u201d \u2022 But surely that\u2019s stupid? Biden and Harris were running for diffferent offices! <\/p>\n<p>Trump (R): \u201cSecret Service urging Trump campaign to stop holding outdoor rallies: Report\u201d [<a href=\"https:\/\/www.aa.com.tr\/en\/americas\/secret-service-urging-trump-campaign-to-stop-holding-outdoor-rallies-report\/3283680\" target=\"_blank\" rel=\"nofollow noopener\">Anadolu Agency<\/a>]. \u201c\u2026 or we can do it the hard way\u201d?<\/p>\n<p><center>* * *<\/center><\/p>\n<p>Lambert here: I remember all those kids in 2008, \u201cfired up and ready to go,\u201d scripts memorized, knocking on doors. Sixteen years later, those kids are drowning in college debt, can\u2019t buy their starter home, and are seeing their paychecks shrink, mostly because the object of their adoration put the banksters back in charge after the Great Financial Crash.
