(Image: Pennsylvania Skill)<\/figcaption><\/figure>\n<p>The state commercial gaming industry, consisting of 17 brick-and-mortar casinos, iGaming, retail and online sports betting, fantasy sports, and video gaming terminals, reported its best May ever with gross gaming revenue (GGR) of <a href=\"https:\/\/www.casino.org\/news\/pennsylvania-gaming-revenue-totals-521m-may\/\">nearly $521 million<\/a>. Pace-O-Matic (POM), the Georgia-based software company that developed the operating system of the <em>Pennsylvania Skill <\/em>games, issued a press release congratulating the casinos on their May to remember while defending its games.<\/p>\n<blockquote class=\"main-blockquote\">\n<p>These numbers show that there is room in the state for both casinos and small businesses that operate skill games to be successful. There is no competition between the two,\u201d declared Mike Barley, a POM spokesperson.<\/p>\n<\/blockquote>\n<p>The legality of skill games in Pennsylvania will soon be reviewed by the <a href=\"https:\/\/www.casino.org\/news\/pennsylvania-skill-games-legality-state-supreme-court\/\">state\u2019s Supreme Court<\/a>. State Attorney General Michelle Henry is appealing the lower courts\u2019 rulings that since the games have elements of skill, they cannot be classified as illegal gambling machines under the state\u2019s Gaming Act.<\/p>\n<h2><strong>Casino Industry Disagrees<\/strong><\/h2>\n<p>Barley\u2019s assertion that skill games aren\u2019t competing for the same player certainly isn\u2019t an opinion shared by the casinos.<\/p>\n<div class=\"callout\">\n<p>Representatives with Parx, the richest casino in the state, said last week that they wouldn\u2019t move forward with building a <a href=\"https:\/\/www.casino.org\/news\/parx-casino-stalls-hotel-construction-plans-cites-skill-games\/\">$100 million hotel<\/a> until the skill game legal saga has played out. Parx in the meantime is acquiring an adjacent smaller hotel to offer patrons on-site lodging.<\/p>\n<\/div>\n<p>Barley says the casinos are simply being greedy.<\/p>\n<blockquote class=\"main-blockquote\">\n<p>Sadly, $521 million a month is not enough to satisfy the greedy casino industry,\u201d Barley stated. \u201cInstead, they want to kill small businesses, American Legions, volunteer fire companies, Moose Lodges, and other places that count on income from skill games.\u201d<\/p>\n<\/blockquote>\n<p>Skill games are unregulated and untaxed, though POM and other skill gaming proponents have asked state lawmakers to <a href=\"https:\/\/www.casino.org\/news\/pennsylvania-skill-gaming-bill-seeks-reduced-tax\/\">pass legislation<\/a> to create a regulatory environment for the machines. The revenue is currently split between the host business, gaming developer, manufacturer, and route distributor.<\/p>\n<p><strong>Legislation that has stalled in the Harrisburg capital amid the skill gaming legal dispute proposed levying a 16% tax on skill games\u2019 gross revenue. Gov. Josh Shapiro (D) has suggested a much higher rate of 42%.<\/strong><\/p>\n<p>Barley says a <a href=\"https:\/\/www.casino.org\/news\/former-pennsylvania-governor-opposes-skill-gaming-tax\/\">low tax is critical<\/a> in allowing the machines to continue providing valuable financial resources to small businesses that have helped offset inflation.<\/p>\n<p>\u201cThese locations could never afford to pay the same tax rate that wealthy casinos pay. Casinos know that but they simply don\u2019t care,\u201d Barley said.<\/p>\n<h2><strong>Skill Game Legality<\/strong><\/h2>\n<p>In late November, Pennsylvania\u2019s Commonwealth Court unanimously upheld a lower court\u2019s ruling that concluded skill games are not gambling games. The court said chance must be the predominating factor in a game\u2019s outcome rather than skill for a game to be a gambling activity.<\/p>\n<blockquote class=\"main-blockquote\">\n<p>Simply because a machine involves a large element of chance \u2026 is insufficient to find the machine to be a gambling device,\u201d Dauphin County Judge Andrew Dowling wrote.<\/p>\n<\/blockquote>\n<p>Henry disagrees and is asking the state Supreme Court to reconsider and classify skill games as illegal gambling machines.<\/p>\n<\/div>\n<p><br \/>\n<br \/><a href=\"https:\/\/www.casino.org\/news\/pennsylvania-skill-developer-dont-compete-casino-slots\/\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Posted on: June 30, 2024, 09:58h.\u00a0 Last updated on: June 30, 2024, 09:58h.
