(Image: <em>Casino.org<\/em>)<\/figcaption><\/figure>\n<p class=\"p1\"><span class=\"s1\">U.S. District Judge Taylor McNeel in Mississippi\u2019s Southern District federal court agreed with MGM\u2019s attorneys that several of plaintiff Brent Nettles\u2019 allegations weren\u2019t warranted to continue. Those allegations included malicious prosecution, gross negligence, and intentional infliction of emotional distress.<\/span><\/p>\n<div class=\"callout\">\n<p class=\"p1\"><span class=\"s1\">But McNeel did determine that Nettles\u2019 other claims, specifically intentional battery and false imprisonment, could move forward. Nettles alleged last year in a federal lawsuit that the <a href=\"https:\/\/www.casino.org\/news\/biloxi-casino-guest-alleges-he-was-wrongly-detained\/\">Beau Rivage\u2019s casino security wrongly detained him<\/a> and \u201cviolently\u201d tackled him and \u201cpinned\u201d him to the ground.<\/span><\/p>\n<\/div>\n<p class=\"p1\"><span class=\"s1\">Casino officials say surveillance video showed an <a href=\"https:\/\/www.casino.org\/news\/las-vegas-boulevard-drunk-driver-killed-motorist-while-speeding-at-140-mph-cops-reveal\/\">intoxicated<\/a> Nettles being asked to leave the premises on the evening of March 11, 2022. Nettles initially complied but quickly changed his mind after claiming he realized he hadn\u2019t paid his bar tab. That\u2019s when casino security said he was trespassing and detained him.<\/span><\/p>\n<h2 class=\"p1\"><span class=\"s1\"><b>Jury to Decide<\/b><\/span><\/h2>\n<p class=\"p1\"><span class=\"s1\">Nettles claimed he wasn\u2019t drunk but was simply enjoying a cocktail with his parents and wife when he was asked to vacate the casino floor and retire to his guestroom. A Florida resident, Nettles says he was lured to the <a href=\"https:\/\/www.casino.org\/news\/mississippi-secretary-scolds-supreme-court-biloxi-decision\/\">Gulf Coast destination<\/a> with a comped stay from MGM.<\/span><\/p>\n<p class=\"p1\"><strong><span class=\"s1\">Nettles told the court that he\u2019s a regular gambler willing to lose up to $20K a year as he finds playing slot machines and table games entertaining. He was sipping on a drink on March 11 after he said he lost about $5K on slots.<\/span><\/strong><\/p>\n<p class=\"p1\"><span class=\"s1\">Nettles said he suffered \u201csevere\u201d physical harm to his radial nerves and has lingering hand pain from the arrest. A <a href=\"https:\/\/www.casino.org\/news\/beau-rivage-casino-would-put-victim-back-together-deranged-killer-hoped\/\">Biloxi police<\/a> officer on the scene charged Nettles with trespassing. He was initially detained for disorderly conduct.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The plaintiff is seeking financial compensation for his related medical expenses and for \u201cpain and suffering.\u201d The jury trial is slated to begin on July 16 at the federal courthouse in Gulfport.<\/span><\/p>\n<h2 class=\"p1\"><span class=\"s1\"><b>Questionable Injuries<\/b><\/span><span class=\"s1\"><b>\u00a0<\/b><\/span><\/h2>\n<p class=\"p1\"><span class=\"s1\">Nettles believes the casino security forcibly handcuffing him resulted in hand nerve pain, numbness, and a tremor. Nettles\u2019 primary care doctor agreed with the diagnosis, but a neurologist\u2019s review of the claimed physical ailments was inconclusive.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">MGM asked McNeel to dismiss the case. The casino said whether Nettles was <a href=\"https:\/\/www.casino.org\/news\/escalating-situation-drunken-vegas-tourist-assaults-man-while-attempting-to-ascend-down-escalator\/\">intoxicated<\/a> is irrelevant, as the resort has the legal right to ban anyone it wishes.<\/span><\/p>\n<blockquote class=\"main-blockquote\">\n<p class=\"p1\"><span class=\"s1\">Plaintiff\u2019s fixation on the intoxication issue is, frankly, irrelevant,\u201d the MGM petition read. \u201cDefendants would have been within their rights to tell the Plaintiff to leave because they didn\u2019t like the shirt he was wearing. Such is the nature of the law permitting business owners to choose their customers.<\/span><\/p>\n<\/blockquote>\n<p class=\"p1\"><span class=\"s1\">\u201cThe critical fact in this entire analysis is that after Plaintiff gave Defendants the impression that he was going to leave, he reversed course without explanation, blew past several security officers, and tried to re-enter the Eight 75 lounge without permission. Whatever motives Plaintiff may have had in doing so are immaterial.
