Notably, though, the NLRB didn\u2019t weigh in on whether student athletes are university employees, leaving the door open for other teams to make that argument. Unfortunately for Northwestern\u2019s players, a union could have aided players in dealing with the reportedly <span><a class=\"sc-1out364-0 dPMosf sc-145m8ut-0 hxZXQQ js_link\" data-ga=\"[[&quot;Embedded Url&quot;,&quot;Internal link&quot;,&quot;https:\/\/deadspin.com\/northwestern-football-pat-fitzgerald-ramon-diaz-lawsuit-1850700312&quot;,{&quot;metric25&quot;:1}]]\" href=\"https:\/\/deadspin.com\/northwestern-football-pat-fitzgerald-ramon-diaz-lawsuit-1850700312\">toxic culture of hazing<\/a><\/span> that took place at the school under former head coach Pat Fitzgerald, leaving some to call on the NLRB to <span><a class=\"sc-1out364-0 dPMosf sc-145m8ut-0 hxZXQQ js_link\" data-ga=\"[[&quot;Embedded Url&quot;,&quot;External link&quot;,&quot;https:\/\/frontofficesports.com\/how-a-union-could-have-protected-northwestern-football-players\/&quot;,{&quot;metric25&quot;:1}]]\" href=\"https:\/\/frontofficesports.com\/how-a-union-could-have-protected-northwestern-football-players\/\" target=\"_blank\" rel=\"noopener noreferrer\">revisit the case<\/a><\/span>.<\/p>\n<p class=\"sc-77igqf-0 fnnahv\">But last month, an NLRB regent official ruled that Dartmouth basketball players are Dartmouth employees, making them eligible to unionize and collectively bargain with the college. In her finding, NLRB regional director <span><a class=\"sc-1out364-0 dPMosf sc-145m8ut-0 hxZXQQ js_link\" data-ga=\"[[&quot;Embedded Url&quot;,&quot;External link&quot;,&quot;https:\/\/apnews.com\/article\/dartmouth-basketball-union-ncaa-employees-19839a9afb5c8048a015cbcb86c0e25b&quot;,{&quot;metric25&quot;:1}]]\" href=\"https:\/\/apnews.com\/article\/dartmouth-basketball-union-ncaa-employees-19839a9afb5c8048a015cbcb86c0e25b\" target=\"_blank\" rel=\"noopener noreferrer\">Laura Sacks said<\/a><\/span>, \u201cBecause Dartmouth has the right to control the work performed by the Dartmouth men\u2019s basketball team, and the players perform that work in exchange for compensation, I find that the petitioned-for basketball players are employees within the meaning of the (National Labor Relations) Act.\u201d<\/p>\n<p class=\"sc-77igqf-0 fnnahv\">Dartmouth, as expected, has appealed to the full NLRB, hoping to overturn Sacks\u2019 ruling, and there are several hurdles for the team to overcome before they could achieve union recognition and begin collective bargaining with the school. But unlike the general feeling that Northwestern\u2019s attempt to unionize was a noble long-shot, Dartmouth\u2019s stab at organizing feels possible, particularly as more and more employees across the country (most notably those at Amazon and Starbucks) fight for labor equality on the heels of big victories for <span><a class=\"sc-1out364-0 dPMosf sc-145m8ut-0 hxZXQQ js_link\" data-ga=\"[[&quot;Embedded Url&quot;,&quot;External link&quot;,&quot;https:\/\/www.thenation.com\/article\/society\/uaw-strike-victory-analysis\/&quot;,{&quot;metric25&quot;:1}]]\" href=\"https:\/\/www.thenation.com\/article\/society\/uaw-strike-victory-analysis\/\" target=\"_blank\" rel=\"noopener noreferrer\">United Auto Workers<\/a><\/span>, <span><a class=\"sc-1out364-0 dPMosf sc-145m8ut-0 hxZXQQ js_link\" data-ga=\"[[&quot;Embedded Url&quot;,&quot;External link&quot;,&quot;https:\/\/news.sky.com\/story\/us-actors-union-sag-aftra-hails-enormous-victory-as-it-ratifies-deal-that-ended-strike-13024025&quot;,{&quot;metric25&quot;:1}]]\" href=\"https:\/\/news.sky.com\/story\/us-actors-union-sag-aftra-hails-enormous-victory-as-it-ratifies-deal-that-ended-strike-13024025\" target=\"_blank\" rel=\"noopener noreferrer\">SAG-AFTRA<\/a><\/span>, and <span><a class=\"sc-1out364-0 dPMosf sc-145m8ut-0 hxZXQQ js_link\" data-ga=\"[[&quot;Embedded Url&quot;,&quot;External link&quot;,&quot;https:\/\/www.vox.com\/culture\/2023\/9\/24\/23888673\/wga-strike-end-sag-aftra-contract&quot;,{&quot;metric25&quot;:1}]]\" href=\"https:\/\/www.vox.com\/culture\/2023\/9\/24\/23888673\/wga-strike-end-sag-aftra-contract\" target=\"_blank\" rel=\"noopener noreferrer\">Hollywood writers<\/a><\/span> (WGA). Media is also currently undergoing its own labor movement, with employees at MSNBC and CBS News Digital recently joining a host of other media outlets (including G\/O Media\u2019s two unions, the GMG Union and the Onion Union) under the banner of the WGA.<\/p>\n<p class=\"sc-77igqf-0 fnnahv\">Of course, it\u2019s possible that the full NLRB will agree with Dartmouth, which claims \u201cathletic pursuit is part of the educational experience\u201d and that \u201cclassifying these students as employees simply because they play basketball is as unprecedented as it is inaccurate. We, therefore, do not believe unionization is appropriate.\u201d And the case could wind up in federal court, which could lead to months, if not years, of litigation, wherein the cause could lose its momentum once again, as it did following the NLRB\u2019s smackdown of Northwestern 10 years ago. But with the NCAA\u2019s reluctant acceptance of NIL dealings among its ranks, and no less an authority than Supreme Court Justice Brett Kavanaugh (I know) <span><a class=\"sc-1out364-0 dPMosf sc-145m8ut-0 hxZXQQ js_link\" data-ga=\"[[&quot;Embedded Url&quot;,&quot;External link&quot;,&quot;https:\/\/www.pbs.org\/newshour\/politics\/watch-live-senate-hearing-on-ncaa-and-student-athletes-profiting-from-name-image-or-likeness#:~:text=Justice%20Brett%20Kavanaugh's%20blistering%2C%20concurring,market%20rate%2C%E2%80%9D%20Kavanaugh%20wrote.&quot;,{&quot;metric25&quot;:1}]]\" href=\"https:\/\/www.pbs.org\/newshour\/politics\/watch-live-senate-hearing-on-ncaa-and-student-athletes-profiting-from-name-image-or-likeness#:~:text=Justice%20Brett%20Kavanaugh's%20blistering%2C%20concurring,market%20rate%2C%E2%80%9D%20Kavanaugh%20wrote.\" target=\"_blank\" rel=\"noopener noreferrer\">writing of the NCAA<\/a><\/span>, \u201cNowhere else in America can businesses get away with agreeing not to pay their workers a fair market rate on the theory that their product is defined by not paying their workers a fair market rate.\u201d<\/p>\n<p class=\"sc-77igqf-0 fnnahv\">Kavanaugh\u2019s concurring opinion was from <em>NCAA v. Alston<\/em>, where the court unanimously held that NCAA restrictions on providing student athletes with non-cash compensation violated antitrust laws, but it sure looks like you can count at least one Supreme Court Justice as being in the \u201cstudent athletes are employees\u201d camp. Kavanaugh flat out called student athletes \u201ctheir workers,\u201d which seems to heavily imply that student athletes are out there performing on behalf and for the benefit of their school.<\/p>\n<p class=\"sc-77igqf-0 fnnahv\">But even beyond legal wrangling, there seems to have been a sea change in the way America views student athletes. As more and more working Americans see billionaire CEOs getting richer while the constant threat of layoffs looms over the rest of us, the argument that getting a degree is compensation enough for playing a college sport doesn\u2019t hit home the way it used to. Sure, plenty of middle-aged dads out there are still grumbling about how they had to pay <em>their own<\/em> college tuition, but there\u2019s a deeper understanding among the general populace of how much money schools are making off players \u2014 Division I athletics generated <span><a class=\"sc-1out364-0 dPMosf sc-145m8ut-0 hxZXQQ js_link\" data-ga=\"[[&quot;Embedded Url&quot;,&quot;External link&quot;,&quot;https:\/\/www.pbs.org\/newshour\/economy\/analysis-who-is-winning-in-the-high-revenue-world-of-college-sports&quot;,{&quot;metric25&quot;:1}]]\" href=\"https:\/\/www.pbs.org\/newshour\/economy\/analysis-who-is-winning-in-the-high-revenue-world-of-college-sports\" target=\"_blank\" rel=\"noopener noreferrer\">$15.8 billion in 2019,<\/a><\/span> and you can bet your bottom dollar that number has gone up since then. <span><a class=\"sc-1out364-0 dPMosf sc-145m8ut-0 hxZXQQ js_link\" data-ga=\"[[&quot;Embedded Url&quot;,&quot;External link&quot;,&quot;https:\/\/www.usatoday.com\/story\/sports\/ncaaf\/2023\/10\/03\/college-football-coach-pay-is-soaring-even-at-basketball-schools\/70924373007\/&quot;,{&quot;metric25&quot;:1}]]\" href=\"https:\/\/www.usatoday.com\/story\/sports\/ncaaf\/2023\/10\/03\/college-football-coach-pay-is-soaring-even-at-basketball-schools\/70924373007\/\" target=\"_blank\" rel=\"noopener noreferrer\">USA Today found<\/a><\/span> that the Power Five conferences will pay their head football coaches an average of $6.2 million in 2024 \u2014 up nearly 15 percent from two years ago. When was the last time you got a 15 percent raise?<\/p>\n<p class=\"sc-77igqf-0 fnnahv\">It\u2019s becoming clearer and clearer to the public that there are a whole bunch of adults making an absolute fortune off the backs of teenagers, many of whom hail from disadvantaged communities, and it doesn\u2019t sit right. Is the Dartmouth ruling the canary in the proverbial coal mine for the college athletics establishment? It may be.
