authorization violated federal law.<\/strong><\/p>\n<\/li>\n And prior compliance with federal law would receive “particular emphasis” in registration decisions.<\/strong><\/p>\n<\/li>\n<\/ul>\n The DEA stated plainly:<\/p>\n “State licenses to manufacture marijuana do not satisfy the requirements of Federal law.”<\/p>\n<\/blockquote>\n It also stated:<\/p>\n “An applicant that has manufactured marijuana without obtaining a DEA registration has violated Federal law.”<\/strong><\/p>\n<\/blockquote>\n And finally:<\/p>\n “The Administrator will place particular emphasis on whether the applicant has demonstrated prior compliance with the Act.”<\/strong><\/p>\n<\/blockquote>\n Those are not opinions.<\/p>\n They are binding federal regulations published in the Federal Register.<\/p>\n Now State Operators Want Into the Same Federal System They Avoided for Years<\/strong><\/p>\n For years, most large cannabis operators built businesses entirely through state licensing systems.<\/p>\n They:<\/p>\n cultivated marijuana,<\/p>\n<\/li>\n distributed marijuana,<\/p>\n<\/li>\n and sold marijuana<\/p>\n<\/li>\n<\/ul>\n without DEA registration.<\/p>\n Now many of those same companies are rushing to enter the federal system after rescheduling announcements created the possibility of Schedule III registration and tax relief.<\/p>\n But DEA’s own application forms now ask applicants whether they previously:<\/strong><\/a><\/p>\n “manufactured, distributed, and\/or dispensed” controlled substances without DEA authorization.<\/strong><\/p>\n<\/blockquote>\n
