California Gov. Gavin Newsom has\u00a0signed SB 53<\/a>, a first-in-the-nation bill that sets new\u00a0transparency requirements<\/a>\u00a0on large AI companies.<\/p>\n SB\u00a053, which\u00a0passed<\/a>\u00a0the state legislature two weeks ago,\u00a0requires large AI labs \u2014 including OpenAI, Anthropic, Meta, and Google DeepMind \u2014 to be transparent about safety\u00a0protocols. It also\u00a0ensures whistleblower protections for employees at those companies.\u00a0\u00a0<\/p>\n In addition,\u00a0SB 53\u00a0creates a mechanism for AI companies and the public to report potential critical safety incidents\u00a0to California\u2019s Office of Emergency Services.\u00a0Companies\u00a0also\u00a0have to report incidents related to crimes committed without human oversight, such as cyberattacks, and deceptive behavior by a model that isn\u2019t required under the EU AI Act.\u00a0\u00a0<\/p>\n The bill has received mixed reactions from the AI industry. Tech firms have broadly argued that state-level AI policy risks creating a \u201cpatchwork of regulation\u201d that would hinder innovation, although Anthropic endorsed the bill<\/a>. Meta and OpenAI lobbied against it. OpenAI even wrote and published an open letter to Gov. Newsom that discouraged his signing of SB 53.<\/p>\n The new bill comes as some of Silicon Valley\u2019s tech elite<\/a> have poured hundreds of millions into super PACs to back candidates that support a light-touch approach to AI regulation.\u00a0Leaders at OpenAI and\u00a0Meta<\/a>\u00a0have in recent weeks launched\u00a0pro-AI super PACs\u00a0that aim to\u00a0back candidates<\/a>\u00a0and bills that are friendly to AI.\u00a0<\/p>\n Still, other states might look to California for inspiration as they\u00a0attempt\u00a0to curb the potential\u00a0harms\u00a0caused by the\u00a0unmitigated advancement of such a powerful emerging technology.\u00a0In New York, a similar bill was passed by state lawmakers and is awaiting Gov. Kathy Hochul\u2019s signature or veto.\u00a0\u00a0<\/p>\n \u201cCalifornia has proven that we can establish regulations to protect our communities while also ensuring that the growing AI industry continues to thrive,\u201d Newsom said in a statement.\u00a0\u201cThis legislation strikes that balance. The bill would regulate AI companion chatbots, requiring operators to implement safety protocols, and hold them legally\u00a0accountable if their\u00a0bots\u00a0fail to\u00a0meet those standards.\u00a0\u00a0<\/p>\n SB 53 is\u00a0Senator\u00a0Scott Wiener<\/a>\u2019s second attempt at an AI safety bill\u00a0after\u00a0Newsom vetoed<\/a>\u00a0his more sweeping SB 1047 last year amid major pushback from AI companies.\u00a0With this bill, Wiener\u00a0reached out to major AI companies<\/a>\u00a0to attempt to help them understand the changes he made to the bill.\u00a0\u00a0<\/p>\n<\/div>\n
